Chowning Poppler is an associate in the San Francisco office of Berman Tabacco. She is committed to seeking justice for investors and consumers in unfair competition, consumer protection, securities and complex litigation.

Since joining Berman Tabacco, she has been an integral member of litigation teams for a number of significant public pension fund clients and has advised clients on various matters.

Prior to joining the firm in 2015, Chowning established her practice as a class action litigator representing workers in employment-related matters in state and federal court.

Chowning’s public interest advocacy skills were cultivated in law school.  She spent a summer interning at the Public Integrity Bureau of the State of New York Office of the Attorney General where she investigated alleged corruption and fraud in local governments.  She also served on her law school’s Pro Bono Legal Advocates board overseeing and coordinating volunteers to assist tenants facing eviction.  Her commitment to social justice is ongoing.  Since 2012, Chowning has served on the board of the North Peninsula Chapter of the ACLU advancing civil liberties in San Mateo County.  In 2019, she was elected as a director on the board of the ACLU of Northern California.

Staying current on trends in the securities arena has further strengthened Chowning’s litigation practice.  She is a co-author of Snap Judgment—S&P Dow Jones and FTSE Russell Indices Ensure That Investors Retain Voting Rights published in Financier Worldwide Magazine in October 2017.  In 2016, she created and presented a continuing legal education course, Securities Litigation Uniform Standards Act (SLUSA) – After the Tort Reform Storm Getting Back to Blue Sky: Maintaining Your Securities Action in State Court.

In 2017, 2018 and 2019, Chowning was named a “Rising Star” by Northern California Super Lawyers magazine.

Experience

  • Currently representing a proposed class of dairy farmers in Carlin v. DairyAmerica, Inc., No. 09-cv-00430 (E.D. Cal.), who allege that a large marketer of non-fat dry milk negligently and intentionally misreported data to the federal government resulting in artificially depressed raw milk prices, which deprived farmers of millions of dollars of income.
  • Part of the team in California Public Employees’ Retirement System v. Moody’s Corp.,CGC-09-490241 (Cal. Super. Ct. San Francisco Cty.), a pioneering case that sought to hold credit rating agencies (Standard & Poor’s and Moody’s) financially responsible for their misrepresentations in rating structured investment vehicles.  The case settled for a total of $255 million in March 2016.
  • Represented investors in matters alleging violations of Sections 10(b) and 20(a) of the Securities Exchange Act.
  • Represented consumers in matters alleging violations of the Truth in Lending Act as well as California’s Unfair Competition Law, Consumers Legal Remedies Act, Song-Beverly Consumer Warranty Act and Automatic Renewal Law.
  • Represented employees in matters alleging violations of the Fair Labor Standards Act, Fair Credit Reporting Act, as well as California’s Fair Employment and Housing Act and Labor Code.
  • Experience includes (i) conducting case analysis; (ii) drafting complaints, class certification briefs, discovery-related motions, mediation statements, preliminary and final approval of class action settlements and briefs in support of attorneys’ fees and costs; (iii) deposition practice, including preparing clients for depositions; and (iv) assisting in settlement mediations. Skilled in propounding and responding to written discovery and leading onsite document reviews.  Experience with courtroom and oral advocacy, arguing motions related to discovery and dismissal.
