Victor S. Elias

Victor Elias is an associate in Berman Tabacco’s San Francisco office.  Victor is dedicated to achieving financial justice for individuals and public pension funds through his litigation of securities and consumer cases.

Since joining Berman Tabacco in 2012, Victor has served as a key member of litigation teams that have successfully secured settlement recoveries totaling hundreds of millions of dollars for individual and institutional investors.  He has litigated securities cases across the country involving the financial services, gaming and energy industries.  He also has experience litigating other complex actions in antitrust, breach of fiduciary duty, consumer protection, unfair competition and design defect cases.  In 2017 and 2018, Victor was named a “Rising Star” by Northern California Super Lawyers Magazine.

Before joining the firm, Victor practiced at a San Francisco Bay Area-based law firm where he focused on securities and antitrust cases.  He also assisted in the representation of individuals in civil rights and personal injury cases, a public retirement system in a false claims action and businesses and government entities in contract actions.

Victor served as a judicial law clerk for two years in federal court for the Honorable Micaela Alvarez at the United States District Court for the Southern District of Texas. He currently serves on the University of Southern California Gould School of Law Board of Councilors’ Judicial Clerkship Committee. During law school, Victor served as an extern for the Honorable Anthony W. Ishii at the U.S. District Court for the Eastern District of California. He also served as an extern for the late Honorable Paul Boland at the California Court of Appeal, Second District.

A Bay Area native, Victor is committed to serving the local community through involvement with legal aid organizations.  He has previously served on the Board of San Francisco La Raza Centro Legal and on committees for California Rural Legal Assistance.

Experience

  • Served as lead associate on team that represented California Public Employees’ Retirement System in California Public Employees’ Retirement System v. Moody’s Corp., No. CGC-09-490241 (Cal. Super. Ct. San Francisco Cty.), a pioneering case that sought to hold credit rating agencies financially responsible for their misrepresentations in rating structured investment vehicles.  The case settled for a total of $255 million, approximately two months before trial was scheduled to start, in March 2016.
  • Played significant role on team that represented co-lead plaintiff Massachusetts Pension Reserves Investment Management Board in In re Fannie Mae 2008 Securities Litigation, No. 08 Civ. 07831 (S.D.N.Y.).  The case settled for $170 million.
  • Served on team that represented lead plaintiff State Universities Retirement System of Illinois in In re General Electric Co. Securities Litigation, No. 09 Civ. 01951 (S.D.N.Y.).  The case settled for $40 million.
  • Served on team that represented lead plaintiff in In re Zynga, Inc. Securities Litigation, No. 12-cv-04007 (N.D. Cal.).  The case settled for $23 million.
  • Assisted in representation of consumers in class actions involving design defect claims and alleging violations of unfair competition and consumer protection laws.
  • Victor’s experience includes: (i) conducting case evaluations and related legal research for potential actions in state and federal courts; (ii) drafting briefs opposing motions for dismiss, related to discovery disputes, for class certification and for settlement mediation; (iii) taking and defending depositions and preparing clients for depositions; (iv) arguing law and motion hearings; (v) propounding and answering discovery requests; (vi) negotiating search protocols for electronically-stored information; (vii) overseeing document review projects; (viii) drafting complaints; and (ix) preparing for settlement mediation.
