Berman DeValerio partner Nicole Lavallee and associate Justin Saif recently published an article in the Fall 2016 issue of the magazine of the California State Association of County Retirement Systems. The article, entitled “The SEC–and Warren Buffett–Scrutinize Non-GAAP Accounting,” discussed the increasing use of non-GAAP metrics in public company reporting and the increasing scrutiny by the SEC and investors of potentially misleading non-GAAP numbers. Regarding the topic’s relevance, Lavallee said, “While this is an issue that certainly informs our case investigations and prosecutions, it is also one of paramount importance to our clients, many of whom rely on the accuracy and comparability of reporting from a multitude of outside investment managers.”
