DraftKings Sports Betting Investigation — Massachusetts

Company Name: DraftKings Sports Betting Investigation — Massachusetts
Ticker: DKNG
Class Period: n/a
Lead Plaintiff Motion Deadline: n/a

Berman Tabacco is investigating potential claims on behalf of Massachusetts residents who used DraftKings Sportsbook, received betting promotions, and lost $1,000 or more on the platform since March 2023.

 About the Investigation

In September 2026, The New York Times reported that DraftKings allegedly used machine-learning tools to direct promotions toward customers predicted to continue betting and losing. DraftKings denies using AI to target customers based on losses or signs of problem gambling. Massachusetts restricts certain uses of customer data to promote betting offers, including offers based on inactivity and offers based on AI systems known or reasonably expected to make a betting platform more addictive.

If you bet after receiving bonus bets, deposit matches, profit boosts, VIP-program solicitations, or other offers—particularly after a break from betting or while trying to limit your play, a free, confidential conversation can help us understand what happened. Contacting us does not mean that you have a claim, and you are under no obligation to retain us.

 About Berman Tabacco

For nearly four decades, Berman Tabacco has represented and recovered millions of dollars on behalf of consumers injured by corporate misconduct, including false advertising and deceptive marketing, product defects, data breaches, and unfair billing and lending practices. Most recently, Berman Tabacco applied its extensive complex class action experience to fight against unlawful and predatory lending practices. We served as lead counsel in several class action lawsuits brought on behalf of individuals who were alleged to have been exploited by illegal online payday lending schemes. The cases alleged that payday lenders issued loans in the name of companies established by Native American tribes, including American Web Loan, Plain Green and Great Plains Lending, in a brazen attempt to dodge usury laws and charge unlawful triple-digit interest rates.
