Berman Tabacco represents the Plaintiff in this derivative action against current and former members of the Board of Directors and executive officers of Centene Corporation. Centene is a health insurance company and the largest provider of Medicaid plans in the country. This action alleges that Centene’s Board failed to oversee compliance while management participated in a scheme to defraud at least 22 taxpayer-funded state Medicaid programs in order to receive inflated payments. The complaint alleges that the scheme involved falsely reporting prescription drug costs. To date, Centene has settled lawsuits and investigations with 17 states, paying more than $939 million, and agreeing to implement government-mandated compliance reforms. The company has announced it will ultimately pay approximately $1.25 billion to state attorneys general and Medicaid agencies.
