Laura M. Falardeau

Laura Falardeau is a project attorney in the Boston office of Berman Tabacco. Since 2011, Laura has represented investors and consumers in complex cases involving market manipulation claims brought under the federal antitrust laws and predatory lending claims under RICO.

Laura’s path in social justice began while in law school at Northeastern University School of Law, one of the top public interest law schools in the nation. As a law student, Laura served as a Hearings Officer at the Boston Public Health Commission in their Tobacco Prevention and Control Program, conducting administrative hearings and appeals to assess violations and fines and working with the executive director in drafting regulations to promote the city’s efforts towards tobacco control in the community. During law school she also interned for Judge Peter W. Agnes, Jr. of the Massachusetts Superior Court, drafting memos on case law and providing support in jury selection and instruction. Prior to joining the firm, Laura was an associate at a Greater Boston firm representing clients in various probate and bankruptcy issues.

Experience

  • Currently serving as a member of the litigation teams in various antitrust and consumer class action cases including Oliver, et al. v. American Express Co., et al., No. 1:19-cv-00566-NGG-SMG (E.D.N.Y.) (antitrust) the Yen Libor matters (market manipulation antitrust actions).
  • Served as member of the litigation teams representing purchasers of EpiPen alleging that their pharmacy benefit managers (PBMs) unlawfully retained manufacturer rebates and other monies at the expense of the purchasers in violation of ERISA.
  • Served as member of the tribal lending litigation team prosecuting federal RICO class action claims against Defendants allegedly running unlawful “rent-a-tribe” online payday lending scheme.
  • Served as member of the litigation team representing institutional investors in antitrust class action alleging certain Wall Street banks manipulated a foreign currency exchange rate benchmark and fixing bid-ask spreads on trillions of dollars of foreign currency exchange transactions.
  • Served as member of the litigation team representing California Public Employees’ Retirement System in pioneering case that sought to hold credit rating agencies (Standard & Poor’s and Moody’s) financially responsible for their misrepresentations in rating structured investment vehicles, ultimately recovering $255 million for the nation’s largest state pension fund.
  • Served as member of the litigation team representing the Ohio Public Employees Retirement System in action against BP p.l.c., which successfully secured a $175 million settlement on behalf of investors following the 2010 Deepwater Horizon oil spill.
  • Served as part of the litigation team that represented the Michigan State Retirement Systems in the Bear Stearns Companies litigation stemming from the 2008 collapse of the company. Plaintiffs successfully recovered $294.9 million for former Bear Stearns shareholders.
